Insolvency and Bankruptcy Code, 2016 read with multiple regulations as well as Rules analogous thereto are a set of laws written in English. The set of laws is available in Hindi also. 'Language' can be defined as the principal method of human communication, consisting of words used in a structured and conventional way and conveyed by speech, writing, or gesture. Thus, be it English or Hindi, the set of laws assembled in the Code should convey same meaning to all. But this does not happen in real life. The perspective differs from class to class, from person to person, from financial service provider to a company in financial distress. The variation in viewpoint is the source of derivation. Disputes occur when two derivations contradict each other, and it is the Judiciary who upholds one of the two conflicting derivations either as a whole or with modifications to suit the legislative intent. read more
